Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DataStark platform and related services (the "Service"), operated by ROOTSHELL TRADING GROUP LTD (Company number 14165761) ("we", "us", "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, both in whole or in part, you must not use the Service and must stop using it immediately.

1. Definitions

  • "Service" – the DataStark website, dashboard, and API that, upon a User's request, return information from third-party and publicly available sources about data leaks and breaches affecting third-party web resources.
  • "User", "you" – any individual or entity that accesses or uses the Service, whether on a free or paid basis.
  • "Operator", "we" – ROOTSHELL TRADING GROUP LTD (Company number 14165761), the operator and owner of the Service.
  • "Leak" / "Breach" – an incident in which data was exposed on a third-party system due to insufficient controls, security failures, or the acts or omissions of third parties.
  • "Source Data" – the underlying third-party and publicly available data that the Service indexes and relays; we are not the author or origin of this data.
  • "Account" – the account you create to access the Service.
  • "Plan" – the free or paid tier governing your access, limits, and applicable fees.

2. Eligibility & Acceptance

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. By using the Service you represent that you meet these requirements and that you will use the Service only for lawful purposes and in accordance with these Terms and all applicable laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. If you accept on behalf of an organisation, you represent that you are authorised to bind it.

You assume full and sole responsibility for your use of the Service and for compliance with all laws applicable to you, including but not limited to data-protection, privacy, anti-spam, and computer-misuse laws. You are solely liable to third parties for your actions in connection with the Service, including where those actions affect the rights or interests of others.

3. Description of the Service

DataStark is an open-source-intelligence (OSINT) search tool. The Service allows authenticated Users to query and correlate information drawn from third-party data sources, including publicly available datasets and previously disclosed data-breach collections, made available through independent upstream providers. The Service aggregates and indexes this information and helps Users assess whether data has been exposed and where.

All Source Data is derived from public and third-party sources automatically. We do not author, verify, evaluate, or control the Source Data, and we make no representation or warranty as to its accuracy, completeness, currency, or legality. Results are provided on an "as is" basis for your own assessment.

The Service may be modified, suspended, or discontinued (in whole or in part) at any time, and the availability of any particular data source is not guaranteed.

4. Role of the Operator ("Enabler")

The Service functions as a search and aggregation layer over data that already exists in the public domain or in third-party datasets. We provide the means to search; we do not select, target, or compile information about any specific individual on our own initiative.

You, the User, are solely and fully responsible for determining the purpose and means of any query you run and for any use you make of the results. You alone decide what to search for, why, and what you do with what you find. You are responsible for establishing and documenting a valid lawful basis for your processing and for complying with all obligations that attach to you as a result, including but not limited to those under the UK GDPR, the Data Protection Act 2018, and any other applicable legislation.

You acknowledge that we are not liable for the existence or dissemination of Source Data that resulted from the acts or omissions of third parties, and that we are under no contractual or legal obligation to delete or restrict information at the original source. Our suppression commitment is set out in Section 10.

5. Permitted Purpose & No Consumer Reporting

The Service is not a credit reference agency or consumer reporting agency, and the results are not "consumer reports". You must not use the Service or any results, in whole or in part, as a factor in determining any person's eligibility for any of the following purposes, including but not limited to:

  • credit, lending, or insurance;
  • employment, volunteering, or professional engagement;
  • housing, tenancy, or the rental of any dwelling;
  • a government licence or benefit, or any other purpose to which consumer-reporting or equivalent legislation applies.

6. Acceptable Use

You are solely and fully responsible for your use of the Service and for any consequences arising from it. You agree that you will not use the Service for any unlawful purpose or in any manner that violates these Terms. Without limiting your responsibility, you must not use the Service to do any of the following, including but not limited to:

  • stalk, harass, intimidate, threaten, defraud, blackmail, or doxx any person;
  • process personal data without a valid lawful basis or in breach of UK GDPR or any other applicable law, or send communications that breach applicable anti-spam or electronic-marketing laws;
  • attempt to gain unauthorised access to any account, system, or data, or to circumvent rate limits, quotas, or security controls;
  • introduce malware or otherwise damage, disrupt, or interfere with the Service or other Users;
  • resell, sublicense, scrape, republish, or redistribute the Service or its output, or share your Account or API key with third parties, except as expressly permitted by your Plan.

This list is illustrative only and is not exhaustive. We may, at our sole discretion, determine the severity of any violation and suspend or terminate access with or without notice, and report conduct to the relevant authorities.

7. Accounts, Plans & Billing

You are responsible for maintaining the confidentiality of your account credentials and any API keys, and for all activity that occurs under your Account. You must notify us promptly of any unauthorised use. Accounts and Plans are for your own use and may not be leased, sold, assigned, or otherwise transferred.

Paid Plans are billed in pounds sterling (GBP, £) and are processed by our third-party payment provider. By subscribing you authorise the applicable charges for the Plan you select, including recurring charges where the Plan is offered on a subscription basis. Usage is subject to the search quotas, monitoring limits, and API limits associated with your Plan; fair-use restrictions apply.

We may change Plan pricing, features, or limits prospectively, with notice where required. We may suspend or restrict access in the event of non-payment, delayed payment, or failed charges.

8. API Use

Where your Plan includes API access, you must keep your API key confidential and use the API only within the rate limits and request quotas published for your Plan. Automated or bulk access beyond those limits, sharing of keys, and any use that degrades the Service or the upstream providers is prohibited. We may revoke API keys that are abused.

9. Refunds

Because access to the Service is provided immediately and is intangible in nature, and except where a refund is required by applicable law, all payments are non-refundable. Refunds are not made for unexpired access periods, unused search allowances, or Plan changes. If you believe you were charged in error or did not receive the service as described, contact us within thirty (30) days of the charge and we will review the matter; any resolution is at our discretion save where the law or payment-network rules require otherwise.

10. Suppression of Search Results

We do not have any contractual or legal obligation to delete, or otherwise restrict access to, information held at its original third-party source, and we are not able to do so. However, as a matter of policy and in support of data-subject rights, upon receipt of a valid formal, written request we will add the relevant identifiers to our suppression list so that they are excluded from, and return no results in, all future searches performed through the Service.

Details of how to make such a request, what it must contain, and how it is handled are set out in our Privacy Policy. Suppression applies to searches run through the Service only; individuals seeking to remove data from, or claim against, third-party sources should apply directly to those third parties.

11. Intellectual Property

The Service, including its software, design, branding, and original content, is owned by ROOTSHELL TRADING GROUP LTD and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. No rights are granted in the underlying Source Data, which remains subject to its own terms and origins. Reproducing the content or structure of the Service requires our prior written permission.

12. Disclaimers

The Service and all results are provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be accurate or complete, and you assume all risks associated with your use of the Service and the information obtained through it. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

13. Limitation of Liability

To the fullest extent permitted by law, ROOTSHELL TRADING GROUP LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or in connection with your use of (or inability to use) the Service or your reliance on any results. Our total aggregate liability arising out of or relating to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

14. Indemnity

You agree to indemnify and hold harmless ROOTSHELL TRADING GROUP LTD and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your queries and use of results, or your breach of these Terms or of any applicable law.

15. Suspension & Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms or applicable law, or to protect the Service or third parties. You may stop using the Service and close your Account at any time. Deleted Accounts cannot be reactivated or restored. Provisions that by their nature should survive termination (including Sections 5 and 11–14 and 16) will survive.

16. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, save that we may bring proceedings to protect our rights in any competent jurisdiction. If any provision is found unenforceable, it shall be limited or removed to the minimum extent necessary and the remaining provisions shall remain in full force.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and posting the revised Terms on the Service. Your continued use of the Service after a change constitutes acceptance of the revised Terms; if you do not agree, you must stop using the Service.
